1. About these Terms

Cadence is operated by Battise Built, a business based in Los Angeles, California, United States ("Battise Built," "we," "us," or "our"). These Terms govern your use of the Cadence mobile app and related Cadence websites, content, subscriptions, and services (the "Service"). Contact us at support@battisebuilt.com.

Please review these Terms before accepting them or purchasing access. If you do not agree, do not create an account or purchase or use the Service. The Privacy Policy at https://www.battisebuilt.com/cadence/privacy explains how information is handled. Acceptance of these Terms is not consent to optional marketing or to any data use that requires separate consent.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into these Terms. You are responsible for providing an email address you control and accurate information needed for your account and purchases. Protect your device, email account, sign-in links, and purchase-redemption links. Do not share access or impersonate another person.

If you mistype a checkout email, lose access to your email, or cannot connect a purchase to the app, contact support@battisebuilt.com. We may require reasonable evidence of account or purchase ownership before correcting access. Do not send full card details or private sign-in links. Do not make a second purchase just to resolve an access problem.

3. What Cadence provides

Cadence provides educational content, self-management tools, reflection and tracking features, and support resources for adults working on smoking or vaping habits. Features and content may change as the Service develops.

Cadence is not a healthcare provider, emergency service, or substitute for diagnosis, medical treatment, or advice from a qualified professional. Using it does not create a clinician–patient relationship. Cadence does not prescribe medication, and its lesson sequence has not been established as a clinically validated treatment. Ask a qualified health professional about medication decisions, persistent or concerning symptoms, and the care appropriate to your circumstances. For an emergency, contact local emergency services.

We do not promise that you will quit, remain nicotine-free, reach a particular health outcome, or succeed within a specified time. Progress displays and cost or time estimates depend on your entries and the assumptions shown in the app; they are not measurements of your health or life expectancy. Use activities only when safe, including avoiding interactive activities while driving.

4. Purchases, trials, and automatic renewal

Some features require a paid subscription. Before you confirm a purchase or trial, the checkout will show the applicable price and currency, billing interval, trial length if offered, when paid billing starts, renewal terms, taxes or fees where applicable, and how to cancel. Those specific offer disclosures apply to your purchase. A trial is available only when expressly offered and when you meet its stated eligibility conditions.

When you affirmatively agree to an automatically renewing subscription, you authorize the disclosed initial and recurring charges until you cancel. Unless the offer states otherwise, a trial converts to the paid subscription disclosed at checkout when the trial ends. Cancel before the displayed conversion or renewal deadline to avoid the next charge.

We will provide purchase acknowledgments and trial, renewal, or price-change notices required by applicable law. Changes to subscription prices or material billing terms will be communicated in advance as required, with an opportunity to cancel and additional consent where required. A later version of these Terms does not silently change an already agreed price or introduce an undisclosed charge.

Web purchases are managed through the billing service used at checkout. Cadence currently uses RevenueCat Billing with Stripe for web payments and RevenueCat for subscription access. If an app-store purchase is offered, the applicable store manages that purchase and its billing rules also apply. The receipt identifies where the purchase was made.

5. Cancellation and refunds

For a web subscription, use the subscription-management link in your purchase email or the billing portal available through the app's Support & account help screen when available for your account. Web subscriptions can be cancelled online without contacting a support agent. If you cannot open the cancellation route or cannot access the purchasing email, contact support@battisebuilt.com for help.

For an Apple subscription, use the subscription controls for your Apple Account. If another app store processed the purchase, use that store's subscription controls. Contact support if you are unsure which billing service applies.

Cancellation stops future renewals. Unless your offer or applicable law provides otherwise, paid access continues through the period already paid for. Trial access may end when a trial is cancelled, as explained by the applicable checkout or store. Verify the cancellation confirmation and effective date.

Deleting the app, signing out, clearing local records, or deleting your Cadence account does not by itself cancel recurring billing. We provide separate account, data, and subscription controls because they have different effects.

Refund eligibility depends on applicable law, the offer accepted at purchase, and the billing provider's applicable process. For a web purchase, contact support@battisebuilt.com with the purchase email and enough transaction information to identify the purchase. For an Apple purchase, use Apple's refund-request process. Nothing in these Terms removes mandatory consumer remedies or makes an advertised refund promise unavailable. Any money-back offer must be expressly stated with its conditions before purchase; there is no general promise of a refund based on a particular quitting outcome.

6. Your records and content

You retain rights in the original content you enter, such as journal entries and personal plans. You authorize only the processing needed to provide the features you request and handle support as described in the Privacy Policy. We do not claim ownership of your personal reflections.

The current app stores personal activity history on your device and does not provide cloud synchronization or guaranteed recovery. Its local activity file is excluded from device backups. Removing the app, clearing local data, or losing or changing devices may result in permanent loss of records. Account sign-in and subscription recovery do not restore local activity history. Keep an independent copy of anything essential to you using the available device or app controls.

7. Permitted use and intellectual property

Subject to these Terms and any applicable app-store license, you may use Cadence for your own lawful personal use. Cadence's software, branding, original lessons, illustrations, and other materials belong to Battise Built or their respective licensors. This permission does not transfer ownership or grant a right to resell or redistribute the Service or its content.

Do not bypass access controls, interfere with the Service, upload malicious software, misuse another person's account, infringe others' rights, or use the Service unlawfully. Restrictions on copying, modifying, or reverse engineering do not limit rights that applicable law does not allow us to restrict.

8. External services and Apple terms

Cadence may link to independent resources or use third-party authentication, billing, and distribution services. Their applicable terms govern your relationship with those services. We remain responsible for our own obligations; referring to a third party does not remove consumer rights you have against us.

For the iOS application, Apple's Standard Licensed Application End User License Agreement applies to the app license unless a separate custom license is supplied through the App Store. These Terms address the Cadence service and do not purport to replace Apple's required license terms or payment rules. Apple's standard agreement is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

9. Account closure and service changes

You may request account deletion at support@battisebuilt.com. We will verify ownership and explain the effects and any limited retention required by law. Separately clear device-only records using the app's local-data controls and cancel billing through the applicable subscription controls if you want all three actions completed.

We may restrict access when reasonably necessary to address fraud, a serious breach of these Terms, security risks, or a legal requirement. Where appropriate and lawful, we will explain the reason and offer a way to contact us. Any restriction, service discontinuation, or material change remains subject to your statutory and contractual rights, including any applicable refund obligations for paid access we fail to provide.

10. Disclaimers and responsibility

We aim to provide a useful, reliable Service, but interruptions, errors, and differences in individual results can occur. To the extent permitted by law, we do not provide additional implied warranties beyond the express commitments in these Terms and mandatory consumer guarantees. We do not guarantee uninterrupted access, error-free content, or a particular outcome from using Cadence.

To the extent permitted by law, neither party is responsible to the other for indirect or consequential losses that were not reasonably foreseeable when the agreement was made. Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, injury where liability cannot lawfully be excluded, or any other liability or remedy that applicable law does not permit us to limit. Mandatory consumer rights remain in effect.

11. Law, disputes, and changes to these Terms

California law governs these Terms to the extent permitted by law, without depriving you of mandatory protections that apply where you live. If you have a problem, contact support@battisebuilt.com so we can try to resolve it. This request does not require you to give up a right to contact a regulator, bring a claim in an appropriate court, or use another legally available remedy. These Terms do not impose mandatory arbitration or a class-action waiver.

We may revise these Terms. We will identify the updated effective date and provide advance notice of material changes where required. If renewed agreement is required, we will obtain it. Changes will not retroactively remove rights concerning an existing dispute or avoid obligations already owed to you. If a provision is unenforceable, the remaining provisions continue to apply to the extent allowed by law.
